These Terms and Conditions set out the basis on which Rubbish Removal Sutton provides rubbish removal and waste collection services to domestic and commercial customers. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Company means the rubbish removal and waste collection service trading as Rubbish Removal Sutton.
Customer means any individual, business, or organisation that requests, books, or uses the services of the Company.
Services means any rubbish removal, clearance, loading, transportation, waste handling, or related services provided by the Company.
Waste means any items, materials, goods, refuse, or rubbish presented for removal and disposal by the Customer.
Site means the property, premises, or location where the Services are to be carried out.
2. Scope of Services
The Company provides rubbish removal and waste collection services, including but not limited to household rubbish removal, garden waste clearance, commercial waste removal, bulky item collection, and general property clearances. The exact scope of Services for each booking will be agreed with the Customer at the time of booking or upon arrival at the Site, subject to inspection of the Waste.
All Services are provided subject to applicable UK waste legislation and regulations, including duty of care obligations and requirements for lawful disposal at authorised facilities.
3. Booking Process
3.1 Bookings can be made by telephone, email, or via any online booking form or booking method made available by the Company. The Customer must provide accurate and complete information, including the address of the Site, contact details, access information, approximate volume or description of Waste, and preferred date and time for the collection.
3.2 Any booking made by the Customer constitutes an offer to purchase Services in accordance with these Terms and Conditions. The booking shall only be deemed accepted when the Company confirms the booking by email, text message, or verbal confirmation, at which point a contract will come into existence.
3.3 The Company reserves the right to refuse or cancel any booking where it reasonably believes that the Service cannot be provided safely, lawfully, or in accordance with these Terms and Conditions.
3.4 All bookings are subject to staff and vehicle availability. While the Company aims to attend within agreed time windows, all arrival times are estimates and are not guaranteed.
4. Estimates and Quotations
4.1 Any price estimates given before arrival at the Site are based on the information provided by the Customer and are not binding. Final prices are confirmed once the team has inspected the Waste at the Site.
4.2 Prices are generally based on the volume, weight, type of Waste, labour involved, access conditions, and any additional services requested.
4.3 If, upon inspection, the quantity or type of Waste differs from the description provided at the time of booking, the Company may revise the quotation. The Customer may accept the revised price or decline the Service. If the Customer declines the Service after the Company has attended the Site, a reasonable call-out or attendance fee may be charged to cover costs incurred.
5. Customer Obligations
5.1 The Customer must ensure safe and reasonable access to the Site for the Company’s staff and vehicles at the agreed time. This includes arranging any necessary parking, permits, or access codes.
5.2 The Customer must clearly identify and present the Waste to be removed. Where partial clearances are requested, the Customer must indicate precisely which items are to be taken and which are to remain.
5.3 The Customer warrants that they are the owner of the Waste or have full authority from the owner to arrange its removal and disposal.
5.4 The Customer must notify the Company in advance of any potentially hazardous conditions, such as unsafe structures, presence of sharps, infestation, or contamination.
6. Waste Types and Prohibited Items
6.1 The Company will remove most common household, garden, and commercial Waste. However, certain items cannot be collected or may require special arrangements, including but not limited to:
Hazardous or toxic waste, such as chemicals, solvents, asbestos, clinical waste, and certain electrical items.
Pressurised containers, gas bottles, or explosive materials.
Liquids, including paints, oils, and fuels, unless specifically agreed.
Biological or medical waste, including syringes and sharps.
6.2 If prohibited items are discovered within the Waste, the Company may refuse to remove them and may adjust the price or decline the entire Service if it is unsafe or unlawful to proceed.
6.3 The Customer remains responsible for any prohibited items presented as Waste and for any costs or liabilities arising from their inclusion, including additional handling, disposal charges, or penalties imposed by disposal facilities or regulators.
7. Performance of Services
7.1 The Company will use reasonable care and skill in performing the Services. Rubbish removal and loading will be carried out in a professional manner, with reasonable efforts to avoid damage to property.
7.2 The Customer or an authorised representative should be present at the Site during the Service to give instructions and confirm which items are to be removed. If no one is present, the Company will use its reasonable judgement based on prior instructions, and the Customer will be responsible for any consequences of incomplete or incorrect instructions.
7.3 Any time frames for completion of the Service are estimates only and may be affected by traffic, access, volume of Waste, weather, or unforeseen circumstances.
8. Payments and Charges
8.1 Unless agreed otherwise in writing, payment is due in full immediately upon completion of the Service at the Site.
8.2 The Company accepts payment by cash, debit card, credit card, or other methods as communicated to the Customer. For business Customers, invoicing and payment terms may be agreed separately.
8.3 All prices are quoted in pounds sterling and may be subject to VAT where applicable.
8.4 If payment is not made when due, the Company reserves the right to charge interest on overdue amounts at the statutory rate, and to recover any reasonable costs incurred in collecting the debt, including legal fees.
9. Cancellations and Amendments
9.1 The Customer may cancel or amend a booking by contacting the Company as soon as reasonably possible before the scheduled attendance time.
9.2 If the Customer cancels less than 24 hours before the agreed arrival window, or if the Company attends the Site and is unable to carry out the Service due to lack of access, incorrect information, or the Customer not being present, the Company may charge a cancellation or call-out fee to cover time and travel costs.
9.3 The Company reserves the right to cancel or reschedule any booking in the event of staff illness, vehicle breakdown, severe weather, unsafe conditions, or other circumstances beyond its reasonable control. In such cases, the Company will notify the Customer as soon as practicable and offer a new appointment, but shall not be liable for any resulting loss of profits, business, or other indirect losses.
10. Liability and Damage
10.1 The Company will take reasonable care when carrying Waste through a property, but the Customer accepts that minor scuffs, marks, or wear and tear may occur, especially in confined spaces or where large or heavy items are being removed.
10.2 The Company’s total liability for any loss or damage arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the amount paid or payable by the Customer for the specific Service giving rise to the claim.
10.3 The Company shall not be liable for:
Any loss of profits, revenue, or business.
Any indirect or consequential loss.
Any pre-existing damage or defect to property or items.
Any loss or damage that arises due to inaccurate or incomplete instructions from the Customer.
10.4 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
11. Waste Handling and Regulatory Compliance
11.1 The Company will handle and transport Waste in accordance with applicable UK waste management laws and regulations, including any required registrations as a waste carrier and obligations to use authorised treatment and disposal facilities.
11.2 By using the Services, the Customer transfers responsibility for the Waste to the Company at the point it is loaded into the Company’s vehicle. From that point, the Company will assume responsibility for transporting and disposing of the Waste lawfully.
11.3 The Customer acknowledges their duty of care in relation to Waste and confirms that they will not request the Company to handle any Waste in a manner that would breach applicable regulations.
12. Customer Indemnity
12.1 The Customer agrees to indemnify and keep indemnified the Company against any claims, costs, penalties, or expenses incurred as a result of:
The Customer’s breach of these Terms and Conditions.
The inclusion of prohibited, hazardous, or misdescribed Waste.
Any failure by the Customer to obtain necessary permissions to remove items or access the Site.
13. Complaints
13.1 If the Customer is dissatisfied with any aspect of the Service, they should notify the Company as soon as possible, providing full details of the issue.
13.2 The Company will investigate complaints and aim to resolve them promptly. Where appropriate, the Company may offer a remedy such as a partial refund, re-attendance, or other corrective action, at its discretion.
14. Force Majeure
14.1 The Company shall not be liable for any delay in performing, or failure to perform, any of its obligations under these Terms and Conditions where such delay or failure results from events, circumstances, or causes beyond its reasonable control. This may include, but is not limited to, extreme weather, acts of God, strikes, lockouts, accidents, breakdowns, road closures, or public emergencies.
15. Data Protection and Privacy
15.1 The Company may collect and process personal data such as names, contact details, addresses, and payment information for the purposes of managing bookings, delivering Services, and handling accounts and queries.
15.2 Personal data will be handled in accordance with applicable UK data protection legislation. The Company will take reasonable measures to keep personal information secure and will not sell personal data to third parties.
16. Variation of Terms
16.1 The Company may amend these Terms and Conditions from time to time. Any updated version will apply to bookings made after the date of publication or notification. It is the Customer’s responsibility to review the latest Terms and Conditions before placing a booking.
17. Severability
17.1 If any provision or part-provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable, it shall be deemed deleted, but that shall not affect the validity and enforceability of the remaining provisions.
18. Governing Law and Jurisdiction
18.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them, or their subject matter or formation, shall be governed by and construed in accordance with the laws of England and Wales.
18.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
